    Having a broker of record for your real estate business in Florida is essential for legal compliance, risk mitigation, transaction management, and access to expertise and networking opportunities.

    How the Process Works

    Register your business name

    Goal: Create an LLC for your new business and receive a Federal Tax Identification Number, also known as a FEIN or Employer Identification Number (FEI/EIN). The FEIN is a unique nine-digit corporate ID number that works the same way a Social Security number does for individuals. If you already have formed your Limited Liability Corporation (LLC) or a similar type of entity recommend by your attorney or tax preparer you can take the step to just add your new Broker of Record as a manager.
    If you remember a test question for the real estate exam is when forming a real estate corporation at least one member of the board must be an active broker.

    Creating Your LLC With Dbpr

Without adequate insurance coverage, businesses and individuals may face significant financial losses or even bankruptcy if they are held liable for these mistakes.

    Application process

    Obtain and complete necessary forms: Obtain the required forms from the Department of Business Professional Regulations (DBPR) or their website, and fill them out completely and accurately.Pay the required fees: Pay the fees associated with registering your LLC with the Department of Business Professional Regulations.File the forms: Submit the completed forms and fees to the Department of Business Professional Regulations. This can usually be done online, but may also require physical submission in some cases. Wait for approval: Wait for approval from the Department of Business Professional Regulations. Processing times can vary depending on the state and workload of the department.

    Sample Broker Agreement

    This agreement supersedes all prior agreements and understandings between the parties relating to the subject matter herein. If any term of this Agreement is adjudicated to be void, voidable, invalid, or unenforceable for any reason, such term shall be automatically severed from all other terms of this Agreement, which will continue in full force and effect. In the event any term is adjudicated to be overbroad as written, such term shall be automatically amended to narrow its application to the extent necessary to make such term enforceable. This Agreement and all remedies at law or in equity shall be construed and in force in accordance with the laws of the State of Florida (without giving effect to its choice of law principles). Both the Broker and the Principal agree that any dispute under this agreement shall have venue and jurisdiction in the state or federal courts of Orange Country, Orlando, Florida.
